Terms of Service

These Terms of Service set out the conditions for illustration and manga commissions handled through Kojika Commissions. Please review these terms before submitting the form. Submitting the form does not confirm the commission. A commission is accepted only after review, estimate, mutual agreement, and payment confirmation.

Section 1. About This Service

This service is for commission inquiries and requests for illustrations, manga, and related artwork by the artist “Kojika.”

Submitting the form means starting a commission inquiry.

It does not confirm the commission, start production, or create a payment obligation.

Section 2. Commission Confirmation

A commission is considered formally accepted only after the following steps are completed:

1. The requester submits the commission details through the form or consultation page.

2. The artist reviews the content, schedule, budget, and feasibility.

3. The artist provides an estimate, production scope, usage terms, and refund conditions.

4. The requester agrees to the proposed terms.

5. The artist provides payment instructions and confirms payment.

The artist may decide whether to accept or decline a commission based on the content, schedule, budget, and feasibility.

Some requests may be declined at the artist’s discretion.

Section 3. Estimates and Pricing

Prices are quoted individually depending on the scope, number of pieces, page count, level of detail, timeline, publication conditions, and whether the requester allows the artist to post the finished work on supporter sites.

Prices and budget ranges shown on the site are estimates only.

The final price will be provided after discussion.

The production scope may be adjusted to fit the requester’s budget, but requests may be declined if the budget and requested scope do not match.

Section 4. Payment Methods and Fees

Payment methods may include Stripe, bank transfer, PayPal, or other methods depending on the request, region, and amount.

Submitting the form does not create a payment obligation.

Payment instructions will be provided after the requester agrees to the estimate.

Production begins after payment is confirmed.

Bank transfer fees, payment processing fees, and transfer-related fees for services such as Stripe or PayPal are generally the requester’s responsibility.

The final payment amount will be clearly provided when the estimate is confirmed.

Section 5. Agreement Before Payment

To ensure a smooth commission process, the production scope, price, estimated timeline, revision scope, delivery format, usage terms, and refund conditions will be confirmed on the consultation page before payment.

The requester may be asked to confirm agreement on the consultation page before payment instructions are provided.

This process helps both sides clearly review the agreed details.

Section 6. Cancellations and Refunds

Cancellations before production begins may be handled individually depending on the situation.

After payment and once production has begun, cancellations and refunds due to the requester’s circumstances are generally not accepted.

If the artist is unable to continue the work for their own reasons, the case will be handled individually depending on the progress.

If there is any issue regarding payment, please contact the artist through the consultation page first.

If a payment service requests information, the artist will respond appropriately based on the agreed scope, delivery records, and consultation history.

Section 7. Production, Timeline, and Delivery

The estimated timeline will be provided during the estimate process or on the consultation page.

The timeline may change depending on the production status, required confirmations, the artist’s circumstances, health, or external service issues.

Delivery will be made by image file, download URL, or another method agreed by both sides.

Section 8. Revisions

Whether revisions are available, how many revisions are included, and what types of revisions are included will be determined individually during the estimate process or on the consultation page.

Revisions beyond the agreed scope, major redraws, or requester-driven changes may require additional fees.

Major changes after delivery or changes that differ from the original agreement may not be accepted.

Section 9. Copyright and Usage Scope

Unless otherwise agreed, the copyright of the delivered artwork remains with the artist.

Copyright is not transferred.

The requester may use the delivered artwork only within the scope agreed in advance.

Use outside the agreed purpose, medium, or scope is prohibited.

Section 10. No Commercial Use

This service generally does not accept commissions intended for commercial use.

Commercial use, resale, redistribution, merchandise production, advertising use, monetized video or streaming use, NFT use, AI training use, and transfer to third parties are prohibited.

If your intended use may be considered commercial, please consult the artist in advance.

The artist may decline requests that are considered commercial use.

Section 11. Publication by the Requester

Publication by the requester on social media, pixiv, supporter sites, blogs, videos, streams, or other platforms is limited to the scope agreed in advance.

Publication, reposting, redistribution, editing, or transfer to third parties outside the agreed scope is prohibited.

If the requester wishes to change the publication scope, they must consult the artist in advance.

Section 12. Publication by the Artist

If the requester agrees, the artist may post the delivered artwork on the artist’s social media, portfolio, pixiv, FANBOX, Fantia, or other supporter sites.

Whether paid supporter-site posting is allowed, the posting timing, whether variations are included, and whether the requester’s name is shown will follow the prior agreement.

The commission fee may be adjusted depending on whether the requester allows artist publication.

If the requester does not want the work to be posted, they should inform the artist before the estimate is finalized.

Section 13. Prohibited Requests and Conduct

The following requests cannot be accepted:

1. Content that infringes third-party copyrights, portrait rights, trademarks, privacy rights, or other rights.

2. Content intended for unauthorized reposting, redistribution, resale, or commercial use.

3. Content that infringes the rights of real people.

4. Content that violates the rules of relevant platforms.

5. Content that unfairly harms the artist, third parties, individuals, or groups.

6. Content that the artist determines to be inappropriate or difficult to handle.

The following conduct is prohibited:

1. Sharing the consultation page URL with third parties.

2. Unauthorized access to the artist/admin URL.

3. Unauthorized reposting, redistribution, or commercial use of delivered artwork.

4. Publication, editing, or use outside the agreed scope.

5. False statements regarding payment, refunds, or delivery.

6. Any other conduct the artist determines to be inappropriate.

Section 14. Consultation Page and Communication

Communication regarding the commission will generally take place through the consultation page or another method specified by the artist.

The consultation page URL is for the requester only.

Please do not share it with others, as anyone with the URL may be able to view the page.

Sharing the artist/admin URL with the requester or any third party is prohibited.

Section 15. External Services

This service may use external services such as Vercel, Supabase, Discord, Stripe, PayPal, and other tools.

Some parts of the service may become temporarily unavailable due to outages, specification changes, maintenance, or account restrictions of external services.

Section 16. Disclaimer

The artist will make reasonable efforts to communicate and produce the commission sincerely.

However, except in cases of intentional misconduct or gross negligence by the artist, the artist is not responsible for damages caused by communication issues, external service issues, payment service issues, or file-sharing service issues.

Nothing in these terms excludes liability beyond what is permitted by applicable law.

Section 17. Changes to These Terms

These terms may be changed when necessary.

Updated terms become effective when posted on this site.

However, for commissions that have already been estimated and agreed upon, the terms agreed at the time will generally take priority.
